Life changing events can happen at the blink of an eye. Are you and your family prepared if something should happen that alters your life or the life of your loved ones?

Documents you may need should a life changing event takes place in your life or the life of your loved ones:

  • Power Of Attorney
  • Last Will & Testament
  • Living Will
  • Provisional Custody by Mandate

Why Do You Need A Power Of Attorney?

Powers Of Attorney, also known as a mandate, is a formal written document that allows the person of your choice to act on your behalf when you are not able to handle your own affairs or speak for yourself.  The powers granted can be written as specific or general.

Your Last Will & Testament and Why getting one should be TOP Priority!

In Louisiana, if you die without a Last Will & Testament, all of your possessions and assets will go to the State.

Having a Last Will & Testament allows your descendants to inherit your possessions and assets. If you have no descendants, then your siblings will inherit your separate property and your spouse will inherit the community property, property you own together. Separate property is considered property you owned before you got married. Community property will include any all things that were purchased or received after being married.

In Louisiana there are two types of Wills that are recognized:

  1. Notarial: A formal document prepared in accordance with your wishes and Louisiana Law. It basically states how you wish for your assets to be distributed after you die. Louisiana has very strict laws on how your Will should be prepared and for this reason you should allow a civil law notary public or a licensed attorney prepare your Will for you!
  2. Olographic: An Olographic Will is written, dated and signed in the handwriting of the person making the will. Notarizing this type of Will may make it invalid and could be challenged by potential heirs.

Living Will

Why do you need a Living Will?

A Living Will gives your family members and your doctors written instructions regarding your medical care and treatment should you become unable to communicate your wishes on your own.

Provisional Custody By Mandate

Do You Have Minor Children? If you answered yes then you may need a Provisional Custody by Mandate at some point in your life.

A provisional custody by mandate grants temporary custody to the person of your choice and allows that person to make decisions regarding your children's health, education and general welfare. This mandate is only considered effective for a year.
